Terms and conditions

These terms and conditions apply to all offers and distance agreements between Osery Couture and consumers via this website.

1. Definitions

In these terms and conditions, Osery Couture is understood to mean: the seller. Consumer: the natural person not acting in the exercise of a profession or business. Distance agreement: an agreement concluded via the internet without the simultaneous physical presence of both parties.

3. Offer and agreement

All offers are non-binding. Osery Couture reserves the right to refuse offers or orders or to set additional conditions. The agreement is concluded at the moment the consumer places an order and it is confirmed by Osery Couture.

4. Prices and payment

All prices are in euros and include VAT, unless stated otherwise. Payment is made in advance via the payment methods offered on the website. In case of prepayment, you cannot derive any rights from the processing of your order until the payment has been received.

5. Delivery

The estimated delivery time is 1–3 business days for the Netherlands, unless otherwise agreed. Delivery times are indicative and do not entitle the customer to dissolution or compensation in the event of a delay.

6. Right of withdrawal (consumer)

You have the right to withdraw from the agreement within 14 days of receipt of the product without giving any reason. During this cooling-off period, you shall handle the product and the packaging with care.

Returned products must be in original condition: unworn, with an unbroken ribbon and all labels still attached.
We cover the costs for the return shipment. Once you have registered your return via our return portal, you will receive a return label by e-mail with which you can return the package.
In the event of a valid withdrawal, the purchase amount will be refunded within a few business days after receipt.
Exception: custom-made or hygienically sealed items that have been opened cannot be returned.

7. Complaints and warranty

Complaints about a delivered product must be reported to us within 2 months of discovery. We strive to handle complaints within 14 days. Osery Couture delivers high-quality products and offers a warranty on manufacturing defects. Reachable via:

8. Liability

Osery Couture is not liable for indirect damages. The total liability is limited to the amount of the order, except in cases of intent or gross negligence.

9. Force majeure

In case of force majeure, Osery Couture is not required to fulfill any obligation. Force majeure includes, among other things: strikes, transport disruptions, technical failures, and other circumstances beyond our control.

10. Intellectual property

All designs, photos, texts, and logos on this website are the property of Osery Couture. Nothing may be copied or published without prior written consent.

11. Applicable law

All our agreements are subject to Dutch law. Should a dispute unexpectedly arise, we will always try to resolve it through mutual consultation first. If we cannot reach an agreement, the dispute may, as a last resort, be submitted to the District Court of Midden-Nederland, Utrecht location, for summary proceedings.
